Royal Decree

amending Article (479) of the Penal Code

We, Idris I, King of the United Kingdom of Libya,

Upon review of:

  • Article (64) of the Constitution;
  • Article (479) of the Penal Code;
  • Based on the submission of the Minister of Justice and the approval of the Cabinet;

decree the following:

Article (1)

Article (479) of the Penal Code shall be amended as follows:

Article (479)

Failure to surrender weapons:

The competent authorities may issue an order to surrender weapons and munitions in the possession of persons or to surrender a type thereof within a specific period.

Anyone who surrenders weapons or munitions in their possession to the police headquarters associated with their residence within the specific period for such shall be exempted from the penalties under Articles (477), (478), and (480) of the Penal Code.

Anyone who violates said order shall be subject to imprisonment for a period of not less than one year and not more than three years and a fine of not less than twenty pounds and not more than one hundred pounds, in addition to the confiscation of the weapon or munition.

Article (2)

The Minister of Justice shall implement this Decree, and it shall come into force on the date of its publication in the Official Gazette.
